Terms of Use — CalorieByte

Welcome to CalorieByte ("the App"), provided by Bruce Decker ("we", "us", "our"). By creating an account, signing in, or using the App, you agree to these Terms of Use ("Terms"). If you do not agree, please do not use the App.

1. The Service

CalorieByte lets you photograph a meal and receive an estimate of its calories and macronutrients, log food by barcode or by hand, record your weight and water, and see those figures over time. Photo analysis is performed by a third-party AI service (Anthropic's Claude). We may add, change, or remove features at any time.

2. Not Medical or Nutritional Advice

The App is not a medical device and does not provide medical, nutritional, or dietary advice. Calorie targets are calculated from a standard formula using the details you enter; they are general estimates and are not personalised to your health, medical conditions, medications, or circumstances.

Do not use the App to diagnose, treat, or manage any medical condition. Talk to a doctor or a registered dietitian before making significant changes to what you eat, particularly if you are pregnant or breastfeeding, are under 18, have a medical condition, or have a history of disordered eating.

If you are struggling with your relationship with food, support is available. In the US, the National Alliance for Eating Disorders helpline is 1-866-662-1235. Elsewhere, please contact a local health service.

3. Estimates Are Approximate

Nutrition estimated from a photograph is frequently inaccurate, especially for portion size. The App shows a confidence indicator and lets you edit every number it produces, and you should. Do not rely on these figures where accuracy matters medically — for example, carbohydrate counting for insulin dosing.

4. Your Account

You sign in using Sign in with Apple. You are responsible for activity under your account. Do not use the App to impersonate others or to gain unauthorised access to any account or system.

5. Subscriptions and Payments

Photo analysis requires an auto-renewing subscription. Logging by barcode and by hand remain available without one.

• A 1-week free trial is offered to new subscribers. If you do not cancel before it ends, the subscription begins and your Apple ID is charged.
• Pricing is $29.99 per year or $8.99 per month, shown in the App at the time of purchase and subject to change with notice as permitted by the App Store.
• Payment is charged to your Apple ID at confirmation of purchase.
• The subscription auto-renews unless cancelled at least 24 hours before the end of the current period.
• Manage or cancel your subscription in your Apple ID settings. Refunds and cancellations are handled by Apple; we cannot process them on Apple's behalf.
• A fair-use limit applies to photo analysis, currently 500 analyses per rolling 30 days. It exists to prevent automated abuse and is far above ordinary use.

6. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose.
• Abuse, overload, reverse-engineer, or attempt unauthorised access to the App or its systems.
• Use automated means to submit excessive requests or data.
• Submit deliberately false nutrition information for barcodes, which other users rely on.

We may suspend or terminate accounts that violate these Terms or abuse the service.

7. Your Data and Contributions

Your use of the App is also governed by our Privacy Policy. You retain ownership of your meals, photos, and other entries. We store them to provide the service.

If you contribute nutrition information for a barcode, you grant us a perpetual, non-exclusive licence to store that contribution and show it to other users of the App. This does not apply to anything else you log.

8. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. We do not guarantee that the App will be error-free, uninterrupted, or secure, that nutrition will be estimated accurately, or that your data will never be lost or corrupted.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BRUCE DECKER WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, OR REVENUE, ARISING FROM OR RELATED TO YOUR USE OF THE APP. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE APP WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) US $10.00.

10. Data Loss

The App stores your data on our servers and does not keep a copy on your device. While we take reasonable measures to protect and back up data, we do not guarantee against loss, corruption, or unavailability.

11. Termination

You may stop using the App at any time, and you can delete your account and data from within it. We may suspend or terminate your access if you violate these Terms or abuse the service. Sections 2, 3, 8, 9, and 10 survive termination.

12. Changes to These Terms

We may update these Terms from time to time. Continued use of the App after changes take effect means you accept the updated Terms. We will update the "Last updated" date above.

13. Governing Law

These Terms are governed by the laws of the State of California, USA, without regard to its conflict-of-laws rules.
